These Terms of Service (“Terms”) govern your access to and use of the website https://soccerperformancelabinc.com/ (the “Website”) and any related services, including but not limited to training programs, bookings, and consultations provided by Soccer Performance Lab Inc. (the “Company”, “we”, “us”, or “our”). By accessing or using the Website or any of our services, you agree to be bound by these Terms. If you do not agree, you may not use our services.
You represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction. Individuals under 18 years of age may only use the services under the supervision and with the explicit consent of a parent or legal guardian. In compliance with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly permit children under 13 to register or provide personal information without verifiable parental consent.
We provide soccer performance training programs, technical skill development, performance testing, and related coaching services for youth athletes aged 5–18 (the “Services”). All bookings, payments, scheduling, and related transactions are processed through our third-party platform Mindbody. By using our Services, you agree to comply with Mindbody’s terms of service and privacy policy, which are incorporated herein by reference.
Training packages commence immediately upon successful payment and scheduling of the first session via Mindbody. Refunds are generally not available after the first scheduled session has occurred, except in cases of documented medical necessity or as otherwise required by applicable law.
The Website may contain links to third-party websites or services, including Mindbody (for bookings and payments), Meta Platforms (Facebook and Instagram, including Pixel and Conversions API for advertising), and Google (for analytics and advertising). We have no control over and assume no responsibility for the content, privacy practices, or terms of these third-party services. Your use of such third-party services is at your own risk, and we recommend that you review their terms and privacy policies carefully.
To the fullest extent permitted by law, the Company, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or personal injury, arising out of or in connection with your use of the Services, even if advised of the possibility of such damages. Our total liability to you shall in no event exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred United States Dollars (USD $100), whichever is greater.
The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of results. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York. You agree to submit to the personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. We will provide reasonable notice of material changes by posting the updated Terms on the Website. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
